These Terms & Conditions ("Terms") govern your use of JobsCatch (the "Service"), operated by Kirmani Enterprises LLC. By creating an account or using the Service, you agree to these Terms.

The Service

JobsCatch is a back-office tool for skilled-trade businesses. It provides appointment booking, a message inbox, quotes, job history, and automated missed-call text-back. Live AI call answering is not part of the current Service.

Accounts and eligibility

You must be at least 18 and able to form a binding contract. You are responsible for keeping your password secure and for all activity under your account. Provide accurate information and keep it current.

Free trial, plans, and billing

New accounts include a 14-day free trial. No card is required to start.
After the trial, plans are Starter at $149/month and Pro at $299/month.
Subscriptions are billed monthly in advance through Stripe and renew automatically until cancelled.
You may cancel at any time; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.
We will give notice before any price change takes effect.

SMS / Text messaging program

What the program does. JobsCatch sends two kinds of text message, and no others:

Missed-call text-back. When someone calls a business phone number connected to JobsCatch and the call is not answered, JobsCatch automatically sends that caller a single SMS reply on the business's behalf. The message identifies the business, tells the caller the business will call them back, and asks what service they need. If the caller replies, their reply is delivered to the business's inbox. This is a conversational reply to a call the caller placed — it is not marketing.
Appointment and account notifications. If an account holder provides a mobile number and affirmatively opts in, JobsCatch may text them appointment confirmations and notifications about their own account.

How consent is obtained.

Callers: consent is established by the caller placing a voice call to the business's published number. The automated text-back is a direct reply to that call, sent only to the number that called, and only for that call. We never text a number that has not called us, and we never add callers to any list.
Account holders: consent is given by entering a mobile number and ticking an unchecked opt-in box at signup. The box is never pre-checked. Consent is not a condition of purchase — you can create an account, start a trial, and subscribe without ever giving a mobile number.

Message frequency may vary. Callers typically receive one message per missed call. Account holders receive messages only when there is something to tell them about their account or appointments.

Message and data rates may apply. Your mobile carrier may charge you for messages you send or receive. JobsCatch does not charge you for text messages; carrier charges are between you and your carrier. Carriers are not liable for delayed or undelivered messages.

Reply STOP to opt out at any time. Text STOP (or END, QUIT, CANCEL, UNSUBSCRIBE, STOPALL) to any message to stop all further messages. You will receive one confirmation message, and then we will not message you again. To resume, reply START or UNSTOP.

Reply HELP for help. Text HELP (or INFO) to any message for support information, or contact us at support@jobscatch.com or https://jobscatch.com.

Supported carriers. Major US carriers are supported, including AT&T, Verizon Wireless, T-Mobile, Sprint, U.S. Cellular, and others. Carrier support is not guaranteed and may change.

Privacy. Your mobile information and SMS consent are handled as described in our Privacy Policy. Mobile information and SMS consent are not shared with or sold to third parties or affiliates for marketing purposes.

Your responsibilities as an account holder

If you use JobsCatch to communicate with your own customers, you are responsible for how you use it. You agree that you will:

Only connect phone numbers you are authorized to use.
Only enter customer phone numbers you have a lawful basis to hold.
Not use the Service to send marketing, promotional, or bulk messages of any kind.
Comply with the Telephone Consumer Protection Act (TCPA), CTIA messaging principles, and any other law that applies to you.
Keep your message templates accurate and non-deceptive, and leave the opt-out language intact.

You may not resell the Service, attempt to breach its security, or use it to send unlawful, harassing, or deceptive content. We may suspend or terminate an account that does.

Your data

You keep ownership of the business data you enter. You grant us the limited right to store and process it in order to operate the Service for you. Our handling of personal information is described in our Privacy Policy.

Service availability

We work to keep JobsCatch available, but we do not guarantee uninterrupted service. Delivery of calls and text messages depends on Twilio and on mobile carriers, and is outside our control. We may modify or discontinue features with reasonable notice.

Disclaimers and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. We are not liable for indirect, incidental, special, or consequential damages, or for lost profits or lost business, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose. Nothing here limits liability that cannot be limited by law.

Indemnity

You agree to indemnify Kirmani Enterprises LLC against claims arising from your misuse of the Service or your breach of these Terms, including claims relating to messages you cause the Service to send.

Termination

You may close your account at any time. We may suspend or terminate an account that breaches these Terms. On termination your right to use the Service ends; data handling follows our Privacy Policy.

Governing law

These Terms are governed by the laws of the United States and the state in which Kirmani Enterprises LLC is registered, without regard to conflict-of-laws rules.

Changes to these Terms

We may update these Terms and will change the "Last updated" date above. Material changes will be communicated before they take effect. Continued use after a change means you accept the updated Terms.
